Copyright Notice

1. Overview

Moduba.com (“Moduba,” “we,” “our,” or “us”) respects the intellectual-property rights of others and expects all users to do the same.

This Copyright Policy explains how to report alleged copyright infringement in compliance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512, and outlines how Moduba responds to valid notices.

2. Designated DMCA Agent

Pursuant to the DMCA, Moduba has designated the following agent to receive notifications of claimed infringement:

Only copyright-related communications should be sent to this address.

Non-DMCA inquiries (including partnership or business requests) should be directed to contact@moduba.com.

3. Submitting a DMCA Notice of Copyright Infringement

If you believe that material available on or through Moduba infringes your copyright, please send a written notification that includes all of the following elements required under 17 U.S.C. §512(c)(3):

  • 1. Your full legal name, physical or electronic signature, and contact information (address, telephone number, and email address).
  • 2. Identification of the copyrighted work claimed to have been infringed (or a representative list of such works if multiple).
  • 3. Identification of the material that is claimed to be infringing and information reasonably sufficient to allow us to locate it (for example, the specific URL).
  • 4. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • 5. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Incomplete notices may not be processed under the DMCA.

4. Counter-Notification Procedure

If you believe that material was removed or disabled by mistake or misidentification, you may submit a Counter-Notice pursuant to 17 U.S.C. §512(g).

Your Counter-Notice must include:

  • 1. Your name, address, telephone number, and email address.
  • 2. Identification of the material that was removed and the location where it appeared before removal.
  • 3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • 4. A statement that you consent to the jurisdiction of any competent U.S. court for the purpose of resolving the dispute and that you will accept service of process from the person who provided the original DMCA notice or that person’s agent.
  • 5. Your physical or electronic signature.

Upon receiving a valid Counter-Notice, Moduba may restore the removed material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the user from engaging in the allegedly infringing activity.

5. Repeat Infringer Policy

Moduba reserves the right to terminate, suspend, or limit access for any user found to be a repeat infringer or who repeatedly violates intellectual-property laws or these Terms of Service.

Decisions regarding repeat infringement are made at Moduba’s sole discretion.

6. Misrepresentations and Abuse

Under 17 U.S.C. §512(f), any person who knowingly makes false claims in a DMCA notice or Counter-Notice may be liable for damages, including costs and attorneys’ fees.

Submitting fraudulent or abusive notices may result in permanent denial of access to the Services.

7. Removal and Restoration Policy

Moduba may remove, disable access to, or modify content alleged to be infringing without prior notice.

We may also retain copies of removed material for record-keeping purposes.

Nothing in this policy limits Moduba’s rights to remove content for reasons unrelated to copyright.

8. No Legal Advice

This policy is provided for informational purposes only and does not constitute legal advice.

If you are uncertain whether specific material infringes your rights, you should seek professional legal counsel before submitting a notice.

9. Arbitration and Dispute Resolution

Any dispute arising from or related to this policy shall be resolved through binding confidential arbitration under the rules of a mutually agreed arbitration provider.

Each party shall bear its own costs unless otherwise determined by the arbitrator.

If arbitration is not possible, disputes may be resolved in any competent jurisdiction chosen by Moduba at its sole discretion.
